Care Dental — Privacy Statement

Care Dental (“Care Dental”, “we”, “us”, “our”) is committed to protecting the privacy of our patients and website visitors (“you”, “your”). This Privacy Statement explains how we collect, use, disclose, and protect personal data in accordance with Vietnam’s Law on Personal Data Protection (Law No. 91/2025/QH15) and its implementing Decree No. 356/2025/ND-CP.

By using our services, visiting our clinic, or accessing our website, you agree to the collection and use of your personal data as described in this Privacy Statement.

Under Vietnamese law, personal data is classified into basic personal data and sensitive personal data. Your dental and medical records, health history, and related clinical information are classified as sensitive personal data, which is subject to stricter protection requirements than basic personal data.

1. Consent

We collect and process your personal data only with your voluntary, specific, and fully informed consent. Consent for sensitive personal data (including your medical and dental records) is obtained separately and explicitly, and is not assumed from silence or inaction. Where a patient is a minor or otherwise unable to provide consent, we obtain consent from a parent or legal guardian.

You may withdraw your consent at any time — see Section 5 below.

2. What Personal Data We Collect

Depending on your interaction with us, we may collect:

Basic personal data:

  1. Full name, date of birth, nationality, passport or identification number;
  2. Contact details (phone number, email address, mailing address);
  3. Emergency contact details;
  4. Appointment history and booking information; and
  5. Payment and billing information.

Sensitive personal data:

  1. Dental and medical history, current conditions, allergies, and medications;
  2. Clinical records including X-rays, CT/CBCT scans, intraoral scans, and treatment photographs;
  3. Treatment notes and diagnostic information; and
  4. Any biometric data collected as part of imaging or scanning procedures.

Sensitive personal data is handled with additional safeguards, including restricted internal access and separate consent, in accordance with the PDPL.

3. How We Use Your Personal Data

We use your personal data for the following purposes:

We do not use your personal data for any purpose beyond what you have consented to, without seeking further consent, except where required by law.

4. Disclosure of Personal Data

We do not sell your personal data. We may disclose personal data only where necessary, to:

  1. Our clinical and administrative staff directly involved in your care;
  2. Third-party dental laboratories involved in fabricating crowns, implants, or other prosthetics for your treatment;
  3. Payment processors, where necessary to complete transactions;
  4. Relevant Vietnamese government authorities, where required by law; and
  5. Any other party you have specifically authorised us to disclose your data to.

Independent record-keeping: Care Dental maintains independent patient records and does not share personal data with other affiliated entities, including those under common ownership or management. Your data collected by Care Dental is held separately and is not accessible to or shared with any other clinic or business, regardless of shared shareholders or corporate structure.

Please note that as a licensed healthcare provider, we are required by Vietnamese law to retain certain clinical records for a minimum period regardless of a withdrawal request. If withdrawing your consent would prevent us from providing safe or legally compliant care, we will explain the consequences before proceeding with your request.

6. Accuracy of Your Data

We rely on you to provide accurate and complete information, and to inform us of any changes (e.g. updated contact details, new medical conditions or medications) so your records remain current.

8. Protection and Retention of Personal Data

We retain personal data only for as long as necessary to fulfil the purposes described in this Statement, or as required by Vietnamese healthcare record-keeping regulations. We take reasonable technical and organisational measures to protect your data against unauthorised access, disclosure, loss, or misuse.

In the event of a data breach, we are required to notify Vietnam’s Ministry of Public Security within 72 hours of detection, in accordance with the PDPL.

9. Changes to This Policy

We may update this Privacy Statement from time to time. Any changes will be posted on this page, and your continued use of our services after such changes constitutes acceptance of the updated policy.

10. Governing Law

This Privacy Statement is governed by the laws of Vietnam, including the Law on Personal Data Protection (Law No. 91/2025/QH15) and its implementing decree.
